Agency Boost LLC ("Agency Boost," "we," "us," or "our")
This Fulfillment, Refund, and Cancellation Policy ("Policy") explains how our services are delivered, when (if ever) refunds are available, how cancellations work, and how payment disputes must be handled. It applies to every Client unless a signed or electronically accepted Master Services Agreement ("Agreement") covers the same subject, in which case the Agreement prevails over any conflicting term in this Policy.
Once your payment is processed and your enrollment is active, you will typically receive a confirmation email, access to the relevant Platform or onboarding instructions, and any scheduling links and program materials that apply to your purchase. Delivery may begin right away, and usually starts within one to two business days.
We treat fulfillment as having occurred, in whole or in part, as soon as any of the following happens:
Your actual participation is not required for fulfillment to be considered delivered.
We may establish that the Services were delivered using records such as Platform login activity, email delivery and open logs, download history, call attendance or recordings, timestamped community or messaging activity, CRM access logs, and calendar confirmations. You agree that these records serve as conclusive evidence that fulfillment occurred.
The only refund available is the one described in your Agreement: you may cancel and receive a full refund only if you have not yet completed your initial one-to-one strategy session. Once that session has taken place, all amounts paid become final, non-cancellable, and non-refundable. This stated window replaces and overrides any outside refund expectation, including any assumed industry-standard period.
After the initial strategy session, no refund will be issued for any reason, including but not limited to lack of use, non-attendance, personal or business circumstances, failure to implement what is taught, dissatisfaction with your rate of progress, or an inability to achieve a particular result. We do not promise any specific revenue or performance outcome.
If a program includes any performance-based commitment, that commitment is a conditional promise of additional service at no extra charge, not a promise to return money. Any such commitment applies only if you fully satisfy the conditions set out in your Agreement, and it is void if you fail to meet those requirements.
For any program that renews or continues past its initial term, you must give thirty days' written notice to stop future billing. Notice must be sent to support@theagencyboost.com. Billing continues through the end of that thirty-day notice period, and no partial-period refunds or credits are provided. Simply stopping participation does not count as cancellation.
Before starting any external dispute or chargeback, you agree to contact us at support@theagencyboost.com so we can attempt to resolve the matter directly.
Except where the law requires otherwise, you agree not to initiate a chargeback, reversal, or payment dispute for any charge that is consistent with this Policy and your Agreement. A chargeback filed after fulfillment has occurred is a material breach of this Policy.
To the fullest extent the law allows, we may immediately end your access to the Services, charge an administrative processing fee equal to the greater of $500 or 10% of the disputed amount, recover processor penalties, legal fees, and damages, submit our evidence of fulfillment and your contractual obligations to the relevant banks, processors, or arbitrators, and pursue any available collection remedy.
We do not guarantee continuous availability of our staff, the Platforms, or any coaching session, and we do not guarantee continued use of any particular Platform.
Disruptions to third-party tools are outside our control, do not amount to a failure to deliver the Services, and do not entitle you to a refund, credit, or cancellation.
We may modify, update, or replace parts of the Services, including schedules, coaches, materials, or delivery methods, at any time in order to maintain or improve quality.
We may suspend or terminate your access immediately, without refund, if you engage in harassment, abuse, or disruptive or defamatory conduct; share or attempt to redistribute our Materials; breach the confidentiality of other clients; file an unauthorized chargeback; miss a payment; or otherwise breach this Policy or your Agreement. Once your access ends, you must stop using all of our intellectual property.
You agree to provide accurate information, maintain the technology access the Services require, implement the strategies and attend the sessions, keep the confidentiality of other clients, comply with all applicable laws (including FTC, TCPA, CAN-SPAM, GDPR, CCPA, and advertising regulations), and conduct yourself professionally. Choosing not to participate does not relieve you of any payment obligation.
You acknowledge that no prior statement, whether spoken or written, creates any right beyond what is set out here and in your Agreement, and that advertisements, webinars, case studies, testimonials, and examples do not alter this Policy or the Agreement. You confirm that you did not rely on any outside representation when deciding to purchase. Only your Agreement and this Policy define the refund and fulfillment terms that apply to you.
All Services are educational and informational. We do not guarantee revenue, profit, valuation increases, sales performance, funnel results, lead volume, or advertising outcomes. Results vary widely and depend on factors outside our control, including your advertising budget, your execution, market conditions, your team and resources, and how you run your business.
You agree to indemnify and hold Agency Boost harmless from any claim, damage, liability, or loss arising out of your own acts or omissions, your use of the Materials or Services, your violation of any law, your breach of this Policy or your Agreement, or any claim brought by your own customers or contacts.
We are not responsible for any delay or failure to perform caused by events beyond our reasonable control, including internet or power outages, labor disputes, natural disasters, Platform failures, acts of terrorism or war, and government restrictions. Events of this kind do not entitle you to a refund or credit.
This Policy supplements your Agreement. Where the two conflict, the Agreement governs and controls, and nothing in this Policy creates rights beyond those set out in the Agreement.
We may revise this Policy at any time. A revised version takes effect when posted, and your continued use of the Services after that point means you accept the updated Policy.
